Under BI-17, the city's pool definition includes any spa or hot tub 18 inches or more deep, so spas generally follow the same permit and barrier framework as pools. The standard recognizes spa exemptions: an in-ground spa less than 8 feet in any dimension with a cover is exempt from barriers, provided the cover stays in place when not in use; and a portable spa with an approved locking cover meeting ASTM ES 13-89 may also be exempt. Lap pools and any spa or pool greater than 8 feet are treated as pools with full barrier obligations. Equipment must be enclosed and soundproofed to meet the noise ordinance. A hardwired or gas spa still needs permits.
A spa exempt only because of its cover loses that exemption if the cover is not kept in place when idle. Installing a hardwired or gas spa without a permit, or noisy equipment violating the noise ordinance, are code violations.
