Riverside County enforces the California Swimming Pool Safety Act (H&S Β§115920 et seq.) and CBC Β§3109, requiring pools and spas deeper than 18 inches to be surrounded by a barrier at least 60 inches tall with at least two of seven approved safety features, such as self-closing self-latching gates, pool covers, or alarms.
Under California Health & Safety Code Β§115922, as amended by AB 2114 (effective 2018), any new swimming pool, spa, or public pool deeper than 18 inches must be equipped with at least two of the seven drowning prevention features: (1) an enclosure that isolates the pool from the home with a 60-inch minimum barrier, self-closing self-latching gate opening outward with latch 54+ inches above ground and gaps not exceeding 4 inches; (2) removable mesh fencing meeting ASTM F2286; (3) an approved safety pool cover meeting ASTM F1346; (4) exit alarms on all doors providing direct access from the home to the pool; (5) self-closing self-latching devices on doors with releases 54+ inches above the floor; (6) an alarm in the pool capable of detecting unauthorized entry; (7) other approved means providing equivalent protection. Riverside County Building and Safety inspects the barrier at final and will not issue a certificate of final until compliance is verified. Ord. 460 Article VI and Ord. 348 incorporate these state standards. Retrofitting an existing unfenced pool is triggered when a building permit is pulled for remodeling or for pool modifications. Fence openings must not exceed 4 inches for vertical members, and horizontal members closer than 45 inches apart count as a climbable ladder. Violations are commonly enforced through Code Enforcement and can block occupancy or final sign-off.
