Showing ordinances that apply to Duane Lake, NY
Duane Lake is an unincorporated community (population 329) in Schenectady County, New York. Because Duane Lake is not an incorporated city, it does not have its own municipal code. Instead, Schenectady County ordinances apply directly to properties here. The fencing requirements rules below are the ones that govern your area.
NYS Residential Code Appendix G requires 48-inch barriers around all pools over 24 inches deep. Schenectady County has no county-specific rule; each municipal building department enforces the state code.
Appendix G specifies that fences surrounding pools must be at least 48 inches above grade on the outside, gates must self-close and self-latch (latch at least 40 inches above grade on the pool side), openings cannot exceed 4 inches, and the bottom gap must be no more than 2 inches. Chain-link fences may not have mesh openings over 2ΒΌ inches. Temporary barriers during construction must meet the same 48-inch minimum and be replaced by permanent fencing within 90 days.
NYS Uniform Code penalties up to $5,000 per day and withholding of Certificate of Compliance.
