EMC Section 33-1109 requires every swimming pool to be enclosed by a natural barrier, wall, fence, and/or other structure with a minimum height of 5 feet, constructed to prevent unauthorized entrance. The enclosing barrier must comply with the California Swimming Pool Safety Act (Health & Safety Code Section 115923) and the International Swimming Pool and Spa Code. Access gates must open away from the pool, be self-closing with a self-latching device placed no lower than 60 inches above the ground. Gaps or voids may not allow passage of a sphere 4 inches or greater in diameter. Outside surfaces must be free of handholds or footholds enabling a child under 5 to climb. The fence may not occupy a required front yard but may occupy side or rear yards. Alternative safety features under H&S Code 115920 include ASTM F2286 mesh fencing and ASTM F1346 safety covers.
