Hemet enforces the California Pool Safety Act: new or remodeled residential pools must include at least two of seven drowning-prevention features. An enclosure must be at least 60 inches high with self-closing, self-latching gates latching no lower than 60 inches and gaps under 2 inches at the ground.
The City of Hemet Building & Safety Division applies the California Swimming Pool Safety Act (Health & Safety Code section 115920 et seq.). Hemet's own Pool Safety Requirements handout states that, as of January 1, 2018, any new or remodeled pool or spa at a private single-family home must be equipped with at least two of seven approved drowning-prevention safety features. If a fence/wall enclosure is chosen, Hemet specifies: a minimum enclosure height of 60 inches; access gates that open away from the pool and are self-closing with a self-latching device placed no lower than 60 inches above the ground; a gap between the ground and the bottom of the enclosure of no more than 2 inches; gaps or voids in the enclosure no wider than 4 inches; and no handholds or footholds a child could use to climb over. The other qualifying features include an approved ASTM F1346 safety cover, ASTM F2286 removable mesh fencing with a self-closing/self-latching key-lockable gate, exit-door alarms, self-closing/self-latching house doors with a release at least 54 inches up, and an ASTM F2208 pool alarm. Hemet's 60-inch enclosure standard exceeds the older statewide minimum 60-inch barrier and reflects the city's adopted requirement. The barrier rules do not apply to public pools, apartment complexes, spas with locking ASTM F1346 covers, or facilities regulated by the State Department of Social Services.
A pool without the required two safety features cannot pass final inspection. Existing pools out of compliance can draw code compliance action. Pool barrier rules are enforced under the building permit and the Pool Safety Act.
