Miami-Dade County Code Section 33-12 and Florida Statute Β§515 establish pool safety barrier requirements. The minimum barrier height is 48 inches above grade measured on the side facing away from the pool. Acceptable barriers include screened-in patios, wooden fences, wire fences, rock walls, concrete block walls, or materials blending with architecture. Wire fences must be two-inch chain link or diamond weave nonclimbable type with top rail and heavy galvanized material. Gates must be self-closing and self-latching with the latch at least 54 inches above ground. Florida law requires at least one additional safety feature: pool alarm, safety cover, door alarm, or self-closing doors. In the HVHZ, all pool barriers must meet hurricane wind load requirements.
Failure to maintain required pool barriers may result in code enforcement action, fines, and potential criminal liability if an incident occurs. No final pool inspection without barriers.
