All swimming pools in North Miami must have a permanent safety barrier at least 48 inches (4 feet) high under the Florida Building Code and Miami-Dade County Section 33-12. The barrier must completely enclose the pool area and have self-closing, self-latching gates. No pool receives final inspection without a compliant barrier. These requirements protect against unauthorized access, particularly by children.
Under the Florida Building Code and Miami-Dade County Code Section 33-12, all swimming pools, spas, and hot tubs must have a permanent safety barrier with the top at least 48 inches above grade on the side facing away from the pool. The barrier must completely enclose the pool area, prohibiting unrestrained access. Acceptable barrier types include screened-in patios, wooden fences, wire fences (2-inch chain-link or diamond weave type with top rail, heavy galvanized material), rock walls, concrete block walls, or other approved materials that blend with the property's architecture. All barriers must be non-climbable and impenetrable. Gates must be spring-loaded and self-closing, automatically returning to a closed and fastened position. Gates must also be equipped with a lock and remain locked when the pool is not in use. For wooden fences, boards, pickets, and louvers must be spaced and constructed to prevent climbing. Wire fences must be non-climbable diamond weave type. No final inspection is granted without an approved safety barrier in place. Permits are required for both the pool and the safety barrier.
