Under OAC 4101:8 Appendix G (Swimming Pools, Spas and Hot Tubs), adopted by Toledo, any pool capable of holding water more than 24 inches deep must be surrounded by a barrier meeting specific standards. Key requirements: barrier height minimum 48 inches measured from the outside; maximum 4-inch gap below the barrier; vertical members spaced no more than 4 inches apart; horizontal members either on the pool side or spaced 45 inches apart minimum; gates open outward from the pool, self-close and self-latch with release mechanism 54 inches above ground. If the house wall serves as part of the barrier, doors leading to the pool must have alarms or the pool must have a power safety cover meeting ASTM F1346. Above-ground pools with removable or lockable ladders may use the pool wall (if 48 inches or taller) as part of the barrier. Hot tubs with locking safety covers meeting ASTM F1346 are exempt from fencing.
