Florida Statute 515.29 governs pool barrier requirements throughout Pinellas County. The barrier must be at least four feet high on the outside, have no gaps a child could crawl through, and be placed to prevent direct access from the home. Gates must open outward away from the pool and be equipped with self-closing, self-latching hardware located out of reach of small children. Section 515.27 also recognizes alternative safety features, including approved safety covers meeting ASTM F1346, exit alarms on doors and windows facing the pool, and self-closing, self-latching doors with release mechanisms at least 54 inches above the floor. Pinellas County code enforcement and building inspectors verify compliance.
Failing to maintain a compliant barrier is a second-degree misdemeanor under F.S. 515.29(4) and can result in code enforcement citations, daily civil penalties, and potential civil liability if a drowning occurs.
