Hot tubs and spas in unincorporated Solano County are exempt from the 60-inch pool barrier if fitted with a locking safety cover meeting ASTM F1346, per California Health & Safety Code 115922(b)(2). Permanently installed spas still require a building permit and electrical permit from Solano County Building & Safety.
California's Swimming Pool Safety Act, enforced by Solano County through County Code Chapter 6.3, treats spas differently from pools. Health & Safety Code Section 115922(b)(2) exempts a hot tub or spa equipped with a locking safety cover that complies with ASTM F1346 from the barrier and safety-feature requirements. A homeowner installing a spa with a code-compliant locking cover therefore does not have to build a 60-inch enclosure around it. A permanently installed spa still requires a building permit and an electrical permit under the adopted California Building Code and California Electrical Code Article 680, which mandates equipotential bonding, GFCI protection, and an accessible disconnect. Self-contained portable spas may have lighter permit triggers, but the Article 680 bonding and GFCI requirements still apply. Apply through Solano County's online permitting portal; contact Building & Safety at 707-784-6765 or building@solanocounty.gov for the spa submittal checklist.
Removing or failing to use the ASTM F1346 locking cover forfeits the exemption, so the spa must then meet the full barrier and safety-feature rules. Installing spa electrical work without a permit, or failing to maintain GFCI protection, is a code-compliance violation that can be red-tagged as an immediate life-safety hazard under the adopted California Electrical Code.
