Full Breakdown
Chapter 195 of the East Brunswick Township Code, Swimming Pools, Private, was adopted by the Township Council on 7-24-62. Section 195-3 sets the basic rule: a permit from the Division of Construction Inspection is required before anyone constructs, installs or maintains a private pool. A private pool is a pool built for the recreation of the owner or occupant of a house, family and guests, located as an accessory use to a residence, and the definition covers the buildings, structures and equipment used with it. Pools that fall under Chapter 197, Swimming Pools, Public, are excluded. A permanent pool that already existed on July 24, 1962 needs no permit unless it is expanded or enlarged. Wading pools are outside the chapter except where it says otherwise.
Under § 195-4 the application goes to the Division of Construction Inspection and must list the applicant's name and address, the street address of the property, a set of plans and specifications showing filtration, chlorination and testing equipment, a scaled plot plan, a description of the fence or enclosure with its type, height and the number and location of gates or doors, and the method of wastewater disposal. The application and all plans and specifications must be in duplicate.
Review has two five-day steps. The Division forwards one copy to the Chief Construction Official, who returns it within five days with findings and recommendations, and no permit issues unless he approves (§ 195-5). The Division then acts within five days, and can approve, disapprove or approve conditionally (§ 195-6). After a conditional approval, an amended set of plans must be filed first, except that for minor changes the Division can issue the permit once the applicant consents in writing. Fees are paid when the application is filed (§ 195-7). Placement is checked against § 195-8, which sets the property line and street line distances and treats that section as part of the Zoning Ordinance, so the Zoning Board of Adjustment handles variances.
Violations & Fines
Constructing, installing or maintaining a private pool without the permit violates § 195-3 of the East Brunswick Township Code. Chapter 195 does not print a separate fine in its own text. Siting a pool inside the distances in § 195-8, or on a lot with no residence on it or an adjacent lot, also violates the chapter unless the Zoning Board of Adjustment grants a variance. Under § 195-14, the owner must abate any health nuisance after notice from the Health Officer or the Code Enforcement Officer.
