East Orange, NJ Swimming Pools & Spas: Pool Permits (2026)

East Orange City Code § 246-2 requires anyone maintaining, operating or using a pool governed by § 246-1, meaning any permanent, portable or collapsible pool with a sidewall more than 50% below grade, to first secure a permit from the Public Officer. The permit application must indicate compliance with § 246-1's fencing requirement: a surrounding fence, wall or other enclosure at least 48 inches high with a gate kept latched or locked whenever the pool holds water and is unattended. Applications are made on forms the Public Officer supplies and must be accompanied by a permit fee set under Chapter 170, Licenses and Fees, tying the pool permit into the City's general fee schedule rather than printing a standalone dollar figure in Chapter 246 itself.

The permit requirement was amended by Ordinance No. 15-1980 (adopted 11-10-1980), and the chapter as a whole traces back to the original 1968 Code provisions (Ch. 9, §§ 9:8-1 through 9:8-2), adopted 3-25-1968 by Ordinance No. 20-1968. Because the permit is conditioned on the fencing compliance shown in the application, the two sections function together: a pool operator cannot lawfully run a covered pool in East Orange without both the physical barrier and the paper permit documenting it.
