Irvington, NJ Swimming Pools & Spas: Pool Permits (2026)

Article II of Chapter 571, Swimming Pools, defines a 'family swimming pool' as any pool with a structural depth over 24 inches, a surface area over 100 square feet, or a capacity over 1,800 gallons, kept as an accessory use for a residence of no more than three families and their guests, without an admission fee. Before that pool can go in, § 571-46 requires a building permit from the Department of Housing Services, with the fee set under Chapter 240, Construction Code, Uniform, and the Department will only issue the permit once the plans comply with this article, the Building Code, the Plumbing Code and Chapter 650, Zoning, and both the permit fee and the separate license fee under § 571-45 have been paid.

That license is a recurring cost on top of the permit: § 571-45 sets it at $98 for the initial year and $52 for each annual renewal for a family pool, or $865 initially and $700 annually for a swim club, and it must be renewed every year by May 1 to stay valid through the following April 30. Location matters too: § 571-44 keeps a family pool at least 10 feet behind the front building line, at least three feet from the rear property line, and requires a side setback of one inch for every foot of property width, capped at three feet per side.

Once installed, § 571-53 gives the Building Inspector, Plumbing Inspector, Health Officer, Sanitarian or any police officer authority to inspect the pool and its surrounding area for continued compliance, and § 571-47 lets the Municipal Council revoke the operating license if the pool becomes a health, safety or morals hazard to users or neighbors.
