Wayne County, IN Swimming Pools & Spas: Pool Permits (2026)

Wayne County treats a swimming pool as a zoning-regulated improvement, not just a building-code item. Section 156.491(B)(4) states plainly that 'no person, firm or corporation shall construct or install a swimming pool or make any alteration thereon or in the appurtenances thereof without having first obtained an improvement location permit for such construction, installation or alteration.' That permit requirement covers the pool shell itself and any later alteration to the pool or its appurtenances, such as a deck, pump house, or filter equipment. Before the permit issues, the pool must also satisfy the siting rules in Section 156.491(A)(2): a private pool may be located anywhere on the premises except in a required front yard, must sit at least ten feet from any property line, and its pump and filter installation must sit at least 20 feet from any property line.

A public pool under Section 156.491(A)(1) faces an additional 200-foot buffer from any lot in a residential district. The application itself runs through the county's general improvement location permit process at Section 156.556, administered by the Wayne County Zoning Inspector, who under Section 156.555 may not issue a permit that conflicts with the zoning chapter. Building without the permit, or altering a pool without a new one, is an ordinance violation under Section 156.999: a fine of $25 up to $2,500 per violation, with each day the unpermitted pool or alteration continues counted as its own separate violation.

The Plan Director may also sue in Wayne Circuit or Superior Court for an injunction requiring an unpermitted pool to be removed, and a permit denial may be appealed to the Board of Zoning Appeals under Section 156.575.
