Town Code Chapter 159 makes it unlawful to construct, maintain, install, or enlarge any swimming pool in West Hartford except in compliance with the chapter, and Section 159-4 specifically bars proceeding with construction, installation, enlargement, or alteration of a permanent private residential pool and its appurtenances without a permit from the Building Inspector. The chapter defines a regulated swimming pool as a receptacle or artificial pool with a depth greater than two feet at any point and a water surface area over 75 square feet.

Before the Building Inspector issues the permit, the owner must submit drawings and plans under Section 159-5, drawn to a scale of at least 1/8 inch to the foot, showing the lot line, fence construction, water supply system, and drainage and disposal systems, plus detailed plans and elevations meeting the Town's building codes. Construction must then follow the approved plans under Section 159-6. The chapter also requires the pool to be a recirculation type with pumps and disinfection equipment, with the surface cleaned at least once every 48 hours, and mandates an escape ladder in any pool over two feet in height or depth.

All structure, wiring, lighting, and piping must conform to Town ordinances and codes. Pool equipment, including pumps and filters, along with the pool itself, must also sit at least 10 feet from any side or rear property line.
