New residential pools in Florida must include at least one safety feature under the Residential Swimming Pool Safety Act (Fla. Stat. Federal law (the Virginia Graeme Baker Act) adds anti-entrapment drain covers. Compliance must be disclosed at resale.
Missing safety features or a deficient barrier blocks final inspection and draws a correction order with fines. Local building officials enforce the barrier standard, and non-compliance carries drowning liability and homeowner insurance consequences.
