Dallas enforces the federal Tobacco 21 minimum age and Texas SB 21 (2019), prohibiting all tobacco and vape sales to anyone under 21. Texas preempts local tobacco regulation, so Dallas has no city flavor ban or supplemental retailer license beyond the Texas Comptroller permit. Military grandfathering applies for some pre-Sept 2019 18-year-olds.
Dallas applies the federal Tobacco 21 law (Dec 2019) and Texas SB 21 (effective Sept 1, 2019), setting the minimum legal age for sale of cigarettes, cigars, e-cigarettes, vape products, and all tobacco-derived items at 21. Retailers must obtain a permit from the Texas Comptroller under Texas Tax Code Chapter 154 and follow Texas Health & Safety Code Chapter 161. State law preempts local flavor bans and independent municipal tobacco regulation, so Dallas has not enacted a flavored tobacco ban or city tobacco retailer license. Active-duty military members 18 or older as of Sept 1, 2019 retain the right to purchase under the grandfather clause. Retailers must post DSHS-prescribed signage and check photo ID for anyone appearing under 30. Compliance is enforced by the Texas Department of State Health Services through random underage decoy operations.
Texas Health & Safety Code §161.0901 imposes fines on retailers: $250 first violation, $500 second, $1,000 third, and up to $5,000 fourth-plus within 36 months. Permit suspension or revocation possible after repeated violations. Missing or improper age-of-sale signage is a separate $100 fine. Furnishing tobacco to minors is a Class C misdemeanor with up to $500 fine.
