Full Breakdown
Two sections of the Village of Hamburg Code control where containers sit and when. Section 198-15C requires all municipal solid waste, recyclable materials, construction and demolition debris, large appliances and bulkies to be at the curb no later than 7:00 a.m. on the day of collection, and it bars placing any material at the curb before 12:00 noon of the day preceding the scheduled pickup day. That window was set by L.L. No. 3-2001, adopted 4-23-2001. Section 198-15D requires the occupants of the property to remove empty containers from the curbline or other place of collection before the end of the day on which collection is made.
Between collections, § 198-9B requires containers on residential property to be stored behind the front setback line of the building on the lot, or secured in a separate structure on the property approved by the Building Inspector, until placed to the curb. Section 198-9C applies the same location rule to properties with more than two dwelling units and to commercial or institutional operations, and it requires waste to be kept in closed refuse totes or in dumpsters the Building Inspector has approved. For stores and other nonresidential buildings, § 198-10B requires waste and recyclable containers to be kept inside the building or in a suitable noncombustible structure located behind the front setback line.
The container itself has rules. Under § 198-12A the lid on every refuse tote and dumpster must be completely closed, and a filled refuse tote cannot exceed 150 pounds. A recyclable container should not exceed 40 pounds when filled (§ 198-8). A refuse tote is Village property assigned to its residential unit and cannot be removed from that residence. Village crews do not enter private property or structures to collect (§ 198-15B), so every container has to be at the curb to be picked up, and § 198-12D bars setting out any can or container other than one holding waste or recyclables.
Violations & Fines
A waste generator who breaks these rules is penalized under § 198-24B: a written warning stating the violation and the fine schedule on the first offense, $50 on the second within one year, $100 on the third, and $200 on the fourth and each later one. All fines double if unpaid within 15 days of the date of issuance of the violation notice.
