Rio Rancho residential carts must be placed at curbside within three feet of the driving surface, set out no earlier than 7:00 p.m. the prior evening and by 7:00 a.m. on collection day, with three feet of clearance from obstructions, and removed within 12 hours after collection.
Container placement for residential collection is governed in detail by Section 50.07(A)(3)(a) of the Rio Rancho Municipal Code. All residential containers, other than those of a qualified physically disabled resident, must be placed for pickup no later than 7:00 a.m. on the regularly scheduled collection day, but no earlier than 7:00 p.m. the evening prior to pickup, unless otherwise authorized by the Sanitation Officer. Except where special circumstances warrant and the city approves, all collections for residents other than qualified physically disabled residents must be made at curbside, and containers must be no farther than three feet from the driving surface of the street. Containers must be clearly visible and accessible to collection vehicles and have three feet of clearance from any obstructions, including but not limited to trees, shrubbery, walls, fences, and vehicles. All emptied containers must be removed from the curb area within 12 hours of collection. In addition, Section 91.21(F) requires receptacles to be located only where readily accessible for emptying and never placed where they constitute a nuisance or obstruction to vehicular or pedestrian traffic, and Section 50.05(C) prohibits allowing any material to accumulate within a minimum three-foot clear space around the circumference of a fire hydrant. Commercial containers are governed separately under Section 50.07(B), which requires enclosures and Sanitation Officer approval for placement; commercial containers may not be placed on R-1 zoned premises, a street, or an alley without prior approval. Chapter 50 violations carry a fine of $25 to $500 (Section 50.99).
Setting carts out too early (before 7:00 p.m. the night before), leaving them out more than 12 hours after collection, placing them more than three feet from the driving surface, blocking access with obstructions, or placing material within three feet of a fire hydrant all violate the placement rules.
