Full Breakdown
Section 102-45 of the Sheboygan Municipal Code sets the set-out window for refuse carts. Under subsection (a), collectable refuse in a department of public works-issued container must be made available to the city collection crews by 7:30 a.m. on the scheduled collection date, and it cannot be put out before 5:00 p.m. on the day preceding that date. The cart has to be removed from the pickup location before 6:00 p.m. on collection day.
Subsection (b) fixes where the cart goes. A property the department of public works has designated for alley refuse and recycling collection puts the cart in an unobstructed location at and parallel to the alley, with the container's numbered side facing the alley. Every other property places it in an unobstructed location at and parallel to the curb of the street, numbered side facing the street. Where no curbs are present, the cart goes at the edge of the roadway, parallel to the street, again with the numbered side facing the street. The ordinance states that no collection will be made from within any garage, shed, residence, building, or vehicle.
Subsection (c) requires each cart to sit at least four feet from any other department of public works-issued container and at least four feet from any other object, such as a tree, mailbox, or parked vehicle. Subsection (d) covers winter: no cart will be collected from atop or behind a snow bank, and when snow is present the resident shall clear a four foot square area around each cart.
A cart that fails these tests is not suitable for collection. Section 102-45(d) sends that cart to subsection 102-2(a), which treats it as just cause for the department of public works to collect it. Section 102-43 separately bars keeping a container directly in front of a residential property, on a front porch, or in the public right-of-way except when placed out for collection in accordance with section 102-45.
Subsection (e) lets a resident request an alternative to subsections (a) through (d) by applying to the superintendent of streets and sanitation, who considers all relevant facts and circumstances and determines what accommodation, if any, is appropriate. The public works committee hears an appeal from that decision.
Violations & Fines
Under section 102-2(a), a violation that leaves refuse or recyclables at the curb or alley line not suitable for collection lets the department of public works collect it after reasonable effort to give 48 hours' notice, and the whole expense plus 50 percent is assessed to the property owner and becomes a lien if unpaid. Section 102-2(c) sets a forfeiture of $50.00 to $250.00 plus costs for a first violation of sections 102-43 through 102-46, and $100.00 to $500.00 plus costs and up to six months without city collection services for the second and each later violation.
