(A) Every tenant, occupier, operator or owner of a residence, commercial, industrial or multi-family residence or construction or demolition site shall not less than once a week cause to be removed all putrescible solid waste created or nonputrescible in combination with such, as per Nevada administrative code 444.662, #4, produced or brought upon the property to an approved disposal site. This may be a single resident pick up site or a common receptacle site as established by the permittee, franchisee or self-hauled to an approved disposal site. Should conditions warrant at any commercial, industrial or multi-residential unit, the community development department in conjunction with the Nevada division of environmental protection may require increased frequency of collection.

Franchises granted by the Board of County Commissioners apply to Salmon Falls, Salt Lake Basin and Midas, and a franchise contract runs five years under 10-12-2(D). Fees are district-specific: Salmon Falls users connected to the Jarbidge water supply system share a fee equally, Midas water system users share the total cost of waste disposal service equally, and every parcel in the Salt Lake Basin carries a fee set by Board resolution and added to the real property tax bill.
Section 10-12-1 defines a residential unit as a single-family home or duplex, occupied when either water or residential light and power services are supplied. Public Works can grant a partial or full fee waiver, after a $150.00 processing fee, for patented mining claims, active agricultural uses, horse corrals and certain commonly used lots. Vacant parcels do not qualify, and an aggrieved applicant has ten days to appeal to the Board of County Commissioners.
Violations & Fines
Section 10-12-7 makes a violation of Chapter 10-12 a misdemeanor, with a separate offense for each day or portion of a day it is not corrected. The fine is not more than $100 for a first violation and not more than $200 for a second. A third and any additional violation is punishable by a fine up to $1,000 or six months in jail, or both. Payment does not excuse correcting the violation, and under 10-12-8 the Code Enforcement Officer can abate it as a public nuisance.
