1. In the Owyhee, Ruby Valley and Elko districts, persons can form cooperative efforts for a common storage bin facility, and when a facility is desired all requirements of Nevada administrative code 444.66647 for a public storage bin facility must be observed (10-12-3(F)). Section 10-12-5(D) bars anyone from accepting solid waste at any place that is not a disposal site permitted under NRS 444.553 or another approved facility, so a bin site cannot double as an informal dump. A container found in deteriorated condition cannot be placed in service under 10-12-4(D).
Violations & Fines
A violation of Chapter 10-12 is a misdemeanor under § 10-12-7, with each day or portion of a day it goes uncorrected a separate offense. The fine is not more than $100 for a first violation and not more than $200 for a second, and a third or additional violation carries a fine up to $1,000 or six months in jail, or both. Section 10-12-8 makes any violation a public nuisance that the Code Enforcement Officer can abate.
