Full Breakdown

The sections read set the container window and the franchise structure; the pickup day for each street is the exclusive franchisee's schedule that Section 40-28(4) refers to. Under Section 40-24(a), except for dumpsters or special arrangement for hazardous waste disposal, all solid waste generated within the city is collected by the city's exclusive solid waste franchisee, and private persons can collect solid waste only from a dumpster. Section 40-24(b) requires each household to subscribe and presumes conclusively that it has subscribed and must pay the applicable charge. Section 40-24(c) applies the same conclusive presumption to every commercial operator or occupant of premises, even one who hauls and disposes of its own garbage elsewhere. If trash accumulates long enough to be a nuisance, the owner or occupant is presumed to have authorized the city to remove it and owes the city's reasonable charges, which are not less than the monthly charge on the current schedule.

Container timing comes from Section 40-28(4). No one can place or keep solid waste containers nearer to the street than the front façade of the building, or on or about the sidewalk, curb or street, at any time other than after 6:00 p.m. on the day before the franchisee is scheduled to collect that street's municipal waste and no later than 10:00 p.m. on the day of collection. Section 40-28(5) sets 24 hours to remedy a violation unless the citation specifies otherwise. Under Section 40-29, public works employees can remove containers unlawfully located at the street after a dated written notice that gives the owner until 8:00 a.m. the next day; removed containers are held at the Public Works Facility until the owner shows proof of ownership and pays any unpaid fines. In snow and ice, Section 38-187 makes persons served by the exclusive franchise responsible for keeping containers accessible so crews and automated equipment can safely remove them.

Billing runs through Georgetown Municipal Water and Sewer Service, which Section 40-25 names as the city's agent for fee collection. It mails statements on or before the first day of the month after service, and the fee is due within 20 days of billing. A delinquent owner or resident receives written notice, and failure to pay within the time in that notice results in disconnection of water service until the account is made current. Rates come from the franchise agreement under Section 40-27, kept for public inspection at the city clerk's office.

Violations & Fines

Violations of Chapter 40, Article II are civil offenses enforced by the code enforcement board, hearing officers and code enforcement officers under Section 40-31. Where no other penalty is assigned they are Class 1 violations under Section 2-842, with an initial fine of $50.00 and $50.00 added for each seven days unremedied, up to $500.00. A citation is waived only if the same or a similar violation has not occurred on the property within the past 24 months and is remedied within the time the citation specifies.
