Summary

Menifee Code of Ordinances § 6.30.050(A) sets a floor of at least once-a-week trash removal for every single-family and multi-family dwelling, whether by franchisee subscription or self-haul, and § 6.30.050(C) lets the City Manager order more frequent pickup or bigger containers wherever weekly service isn't enough to prevent a nuisance.

(A) Single-family dwelling; multi-family dwelling. With the exception of vacant premises meeting the provisions of § 6.30.030(B) above, not less than once per week, every owner, occupant or person in possession, charge or control of any single- family dwelling or multi-family dwelling within the city shall remove by self-hauling (as provided herein) or cause to be removed by subscription to services provided by a franchisee all solid waste stored, generated, collected or accumulated on such premises.

(C) Modifications to collection frequency. The City Manager may provide written notice to the owner of any premises that the above minimum removal requirements are not sufficient to avoid the creation of a public nuisance due to unique circumstances at such premises. City may direct that solid waste shall be removed by the owner of any premises so notified on a more frequent schedule (as determined by the City Manager) and/or that additional or larger containers shall be utilized (as determined by the City Manager).

Full Breakdown

050(A) sets the baseline for residential service: every single-family and multi-family dwelling in the city must have all solid waste removed at least once per week, either through self-hauling as authorized elsewhere in the chapter or through a subscription to the city's franchised hauler. 050(B) applies the identical once-a-week floor to commercial premises. 030(B), for a property that has sat empty 45 days or more. 050(C) gives the City Manager authority to override it whenever the minimum schedule isn't enough to prevent a public nuisance at a particular property, whether because of the volume of waste generated or other unique circumstances.

In that case, the City Manager can order the owner onto a more frequent removal schedule, require additional containers, or require larger containers, and that determination is made unilaterally by the City Manager rather than by request of the resident. 050 then fixes how often that service or self-hauling has to actually happen. 120(B) as a misdemeanor (up to $1,000 fine, six months in jail) or an infraction ($100 to $500 for repeat violations).

Violations & Fines

Letting solid waste accumulate for longer than a week, or ignoring a City Manager order under § 6.30.050(C) to increase pickup frequency or add containers, is treated as a public nuisance under § 6.30.060(A)-(B). Section 6.30.120(B) allows a misdemeanor charge (up to $1,000 fine, six months in jail) or a graduated infraction fine from $100 to $500 for repeat violations.

Frequently Asked Questions

How often does trash have to be picked up in Menifee?
At least once a week. Menifee Code of Ordinances § 6.30.050(A)-(B) requires every single-family dwelling, multi-family dwelling, and commercial premises to have solid waste removed on at least a weekly schedule, whether through the franchised hauler or an approved self-haul arrangement.
Can the city force my property onto more frequent pickup than weekly?
Yes. Section 6.30.050(C) lets the City Manager give written notice that the once-a-week minimum isn't enough to prevent a nuisance at a specific property, and order a more frequent removal schedule or require additional or larger containers, based on that property's circumstances.
Is there any way to skip weekly trash service in Menifee?
Only under the vacancy exception in § 6.30.030(B), incorporated by reference into § 6.30.050(A): a property vacant for 45 days or more isn't required to maintain service during that vacancy, but the owner must be able to show the city reasonable evidence of the vacancy.
