Violations & Fines
Violations of the recycling program requirement fall under Section 6.30.120, which lets the City Manager or City Attorney charge each day of noncompliance as a separate misdemeanor or infraction. A misdemeanor conviction carries a fine up to $1,000, up to six months in county jail, or both. An infraction carries $100 for a first offense, $200 for a second offense of the same provision within a year, and up to $500 for a third or later offense. Every violation is also a declared public nuisance subject to abatement, and the city can recover attorneys' fees and litigation costs.
