Summary

Every owner or occupant of property in Midwest City must sign up for city garbage service and pay the monthly charge; a narrow, renewable-annually exception exists but using a private hauler does not qualify for one.

All owners or occupants of all premises in the city shall be required to obtain garbage service from the city and pay the monthly charges as prescribed in this chapter.(b)Exception. An owner or occupant of any premises in the city may apply to the utilities superintendent for an exception to the requirement contained in subsection (a) of this section. The utilities superintendent may grant such an exception upon a showing that the service is not necessary for the premises for which the owner or occupant is requesting the exception. Service provided by a private hauler shall not be grounds for an exception. Application shall be made on a yearly basis. No exception granted by the utilities superintendent shall be valid for a period exceeding one (1) year. (Code 1972, § 16-4; Ord. No. 2418, § 1, 8-28-90; Ord. No. 2816, § 4, 7-10-01)

Full Breakdown

Section 18-23 makes city garbage service mandatory for every owner or occupant of premises in Midwest City, not optional trash pickup. An owner or occupant can apply to the utilities superintendent for an exception, but it is granted only on a showing that service isn't necessary for that property, and having a private hauler already does not count as grounds. Exception applications are yearly, and no exception the superintendent grants is valid for more than one year, so property owners must reapply annually or resume mandatory service.

Violations & Fines

Section 18-6 makes it an offense to fail, neglect, or refuse to comply with any provision of chapter 18, including the section 18-23 mandatory service requirement, unless a current exception is on file.

Frequently Asked Questions

Can I skip city trash service and hire a private hauler instead?
No. Section 18-23 says using a private hauler is not grounds for an exception; you must still obtain and pay for city garbage service.
How do I get out of mandatory garbage service in Midwest City?
Apply yearly to the utilities superintendent, who may grant an exception only by showing service isn't necessary for that specific premises; approval lasts at most one year.
