Summary

In unincorporated Cumberland County, solid waste may only leave your property through the specific collection services and facilities the county authorizes: county drop-off facilities, a permitted commercial hauler, or self-hauling under load limits. Using any other collection method is itself a code violation.

These county ordinances apply to unincorporated areas of Cumberland County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Only the solid waste collection services and facilities hereinafter specified are authorized to be provided and used for the collection of solid waste generated on or within premises subject to this article. The provision or use of collection services not authorized herein is a violation of this chapter. This article is applicable to the collection of designated solid waste.

Full Breakdown

County Code Sec. 11-31 limits residents to "only the solid waste collection services and facilities hereinafter specified" and makes using an unauthorized collection method a violation of Chapter 11. Under Sec. 1, county collection facilities take waste from noncommercial residential premises only, in individual loads capped at four cubic yards; Sec. 2 bars commercial haulers and non-owner-occupants from using these county drop-off sites. Residents may instead contract with a commercial solid waste collector, but only one holding a permit issued by the county health department, per Sec.

11-33. Owners may also self-haul their own waste under Sec. 11-34: up to four cubic yards per load requires no permit, but hauling more than four cubic yards requires the same health department permit and conditions that apply to commercial collectors. Sec. 4 and Sec. 3 both require that waste be transported so nothing escapes the vehicle; losing waste onto another person's property during transport is itself a separate violation. Before collection, Sec. 11-21(a) caps on-premises storage at no more than seven days and requires storage in receptacles sized to hold everything generated on-site, per county board of health rules, with designated recyclables segregated out before pickup or drop-off under Sec. 11-21(d).

Violations & Fines

Using an unauthorized collection service or facility is a violation of Chapter 11 under Sec. 11-31. Losing solid waste from a transporting vehicle onto property other than the user's own or the collection facility is a separate violation under Sec. 11-32.4. Storing waste on-premises longer than seven days, or in receptacles that don't meet county board of health storage rules, also violates Sec. 11-21(a).

Frequently Asked Questions

Who can pick up my trash in unincorporated Cumberland County?
Only an authorized method under Sec. 11-31: a county collection facility (residential loads up to 4 cubic yards), a commercial hauler holding a county health department permit, or self-hauling your own waste, which is unpermitted only up to 4 cubic yards per load.
How long can I store trash on my property before it's picked up?
No more than seven days under Sec. 11-21(a), and it must be kept in receptacles large enough to hold everything generated on the premises under the county board of health's storage rules.
Can I haul more than four cubic yards of my own trash to the dump?
Yes, but Sec. 11-34(2) requires you to first get a permit from the county health department, and your hauling then becomes subject to the same conditions imposed on commercial collectors.
