Sec. 10-17(c) of the City Code says dumpsters already in place when the refuse ordinance took effect can stay in use only until they are no longer in good working condition, and that the City will not approve any new dumpsters going forward. The Department may also refuse to empty a dumpster that its trucks cannot handle safely or that the Director judges unsafe. In practice this pushed most nonresidential accounts onto the automated cart system described in Sec. 10-13, leaving dumpsters as a shrinking, grandfathered option for downtown business and commercial district properties covered by Sec.

10-14 and Sec. 10-15. Any dumpster enclosure that remains, or any new one built as part of a development project, is governed by Sec. 10-18. The enclosure must be designed, located, and built to the City's standard construction details, and any enclosure proposed through the development review process must also satisfy the Land Management Code. Every enclosure has to sit on a poured concrete platform. If the Director decides a road could be damaged by collection trucks, is unsafe for them to travel, or that the location threatens the safety of crews, equipment, or private property, the Department will assign an alternate pickup point, and if none can be found, may discontinue service to that address altogether.

The property owner, tenant, or person in control of the property is responsible for keeping the enclosure clean, safe, and functioning as built, clearing snow and ice, and keeping vehicles from blocking access.
