Summary

Texarkana requires construction and remodeling sites to collect debris in an approved roll-off or metal container, covered daily, so nothing blows onto neighboring property.

Property owners and any person working for the property owner, or person in control of the property, must use approved containers for any debris associated with construction, remodeling, building material and workmen's litter. All debris from construction, building or any related activity shall be properly placed in the approved construction site container at the end of each day to prevent the debris from being blown or otherwise scattered on the construction site or adjacent property. All liquids, food waste, and bio-waste shall be packaged separately in a manner that prevents leaks and disposed of in accordance with all applicable laws. Approved construction site container is defined herein in section 22-1.

Full Breakdown

City Code § 22-5 requires property owners, contractors, and anyone controlling a construction, remodeling, or demolition site to use an "approved construction site container" for all debris, building material, and workmen's litter. Per § 22-1, that means a trailer or metal roll-off box sized to hold the site's waste and capable of being covered with a lid or tarp. All debris must be loaded into it by the end of each work day so nothing blows or scatters onto the site or adjacent lots, and liquids or bio-waste must be bagged separately and disposed of under applicable law. Separately, § 22-2(c) gives the city's contracted hauler exclusive rights to service compactors and front-end load containers (commercial dumpsters) citywide.

Violations & Fines

Misdemeanor citation under the Ch. 1 general penalty, § 1-5(b)(2): sanitation violations carry up to a $2,000 fine, with each day of noncompliance a separate offense.
