Summary

Victorville treats roll-off boxes as a temporary use only: they're allowed on a job site tied to an active building permit, or under a Temporary Use Permit capped at three months per calendar year, unless the operator secures full Site Plan approval for permanent screened placement. Commercial and multifamily properties must otherwise use a permanent, masonry-walled waste enclosure reviewed by the Zoning Administrator.

(f)Roll-off boxes. Unless reviewed and approved in conjunction with a Site Plan entitlement that includes access in accordance with the California Building Code, screening via masonry wall and landscaping, solid metal access gates, and stormwater pollution prevention measures, roll-off boxes are permitted only as a temporary use. The temporary use of roll-off boxes is allowable during construction in conjunction with an active building permit or as approved by a Temporary Use Permit for a period not to exceed three months per calendar year, in connection with a principal use on the property, pursuant to Section 16-3.07.050 of the Municipal Code.

Full Breakdown

Under Municipal Code Section 16-3.24.110, every new commercial development, every new multi-family project sharing a waste enclosure, and any existing commercial project that triggers a planning entitlement such as a site plan review or conditional use permit must provide a permanent waste enclosure holding separate garbage, recycling and organics containers. The Zoning Administrator reviews every enclosure design, and new enclosures require a building permit shown on the site plan. Enclosure gates must open a minimum of twelve feet, use double gates with panels no longer than twelve feet each, and be lockable with a padlock or keypad; walls must be masonry construction matching the primary building, with a roof at least eight feet high at its lowest point.

Roll-off boxes fall outside that permanent-enclosure system. Section 16-3.24.110(f) treats them as a temporary use unless the applicant obtains full Site Plan approval covering California Building Code access, masonry screening and landscaping, solid metal gates and stormwater controls. Absent that approval, a roll-off container may sit on site only during active construction under a building permit, or under a Temporary Use Permit issued under Section 16-3.07.050, and that temporary placement cannot exceed three months in any calendar year connected to a principal use on the property. All necessary entitlements or building permits must be secured before any enclosure, including a roll-off screening area, is built, and the Planning Commission alone may grant exceptions to these standards through a Site Plan application under Section 16-3.01.030.

Violations & Fines

The Code Enforcement Official issues a Notice of Violation for waste left outside an enclosure or for noncompliant roll-off placement. A third Notice of Violation within twelve months lets the Official require a tamper-proof dumpster. After four documented instances of uncontained waste, even with a tamper-proof dumpster in place, the Official must require the property to install a fully conforming waste enclosure under Section 16-3.24.110(j)(2).

Frequently Asked Questions

Can a business keep a roll-off dumpster on site indefinitely in Victorville?
No. Under Section 16-3.24.110(f), a roll-off box is a temporary use unless it's covered by a Site Plan approval with masonry screening, access and stormwater controls. Without that approval, it may only sit on site during active construction under a building permit, or under a Temporary Use Permit for up to three months per calendar year tied to a principal use.
Does a new Victorville business need a permit for its trash enclosure?
Yes. Section 16-3.24.110(c)(1) requires the Zoning Administrator to review every waste enclosure design, and all new enclosures need a building permit shown on the site plan. Commercial projects must provide separate space for garbage, recycling and, where applicable, grease or oil containers, sized to the tonnage the use generates.
What happens after repeated complaints about an overflowing dumpster?
The Code Enforcement Official issues a Notice of Violation each time. A third violation within twelve months can trigger a requirement for a tamper-proof dumpster, and a fourth documented instance of uncontained waste requires the property to build a fully conforming enclosure under Section 16-3.24.110(j)(2).
