Section 13-4 makes it unlawful to throw, drop or deposit waste, including but not limited to garbage, ashes, rubbish, building rubbish, dead animals, putrescible matter, spilled excavated dirt, tree limbs, leaves, grass clippings, or anything injurious to health, on any premises or vacant property in the city. A second sentence in the same section repeats the ban for streets, avenues, alleys, highways, footways, sidewalks, parks or any other public place. The section carves out two narrow exceptions: depositing wastes that are not injurious to health on a public site with the board of health's permission, and filling or grading property with earth, mud, ashes and similar material, along with building rubbish disposed of under the rest of the Code.

Because Article I of Chapter 13 does not set its own fine, a Section 13-4 violation is punished under the Code's general penalty in Section 1-11, which applies whenever an ordinance declares an act unlawful without listing a specific penalty. The general penalty section makes clear that each day a violation continues, such as an unremoved pile of dumped waste, is treated as its own separate offense unless the Code says otherwise.
