Illegal dumping is a state crime enforced countywide. Under Texas Health & Safety Code § 365.012, disposing of litter or solid waste anywhere other than an approved site is an offense, ranging from a Class C misdemeanor up to a state jail felony for large loads.
Unlike zoning, illegal-dumping enforcement is available to Nueces County across both incorporated and unincorporated land through Texas Health & Safety Code § 365.012. Any disposal of litter or solid waste at a place that is not an approved solid waste site is an offense. Penalties scale by weight/volume: five pounds or five gallons or less is a Class C misdemeanor; larger loads climb to Class B, Class A, and a state jail felony at 1,000 pounds or 200 cubic feet. Corpus Christi also bars littering and accumulation on lots (§ 22-6) and construction-site litter (§ 22-4).
