Summary

Carlsbad's SB 1383 implementation requires every generator to keep food scraps and yard trimmings out of the trash under Municipal Code Section 6.08.020, and requires tier one commercial edible food generators, since January 1, 2022, and tier two generators and large venues, since January 1, 2024, to recover surplus edible food under Section 6.08.027.

Tier one commercial edible food generators must comply with the requirements of this section commencing January 1, 2022, and tier two commercial edible food generators, including, but not limited to, large events and large venues as defined in this chapter, must comply commencing January 1, 2024, pursuant to 14 CCR Section 18991.3. Commercial edible food generators shall comply with the following requirements: 1. Arrange to recover the maximum amount of edible food that would otherwise be disposed. 2. Contract with or enter into a written agreement with food recovery organizations or food recovery services for: (a) the collection of edible food for food recovery; or (b) acceptance of the edible food that the commercial edible food generator self-hauls to the food recovery organization for food recovery. 3. Not intentionally spoil edible food that is capable of being recovered by a food recovery organization or a food recovery service.

Full Breakdown

020(B). The chapter implements what it calls SB 1383, referencing the 2016 state law and CalRecycle's Short-Lived Climate Pollutants regulations adopted November 3, 2020. 027 layers on a food-recovery mandate for businesses: tier one commercial edible food generators had to comply starting January 1, 2022, and tier two generators, including large events and large venues, starting January 1, 2024. Those businesses must arrange to recover the maximum amount of edible food that would otherwise be thrown out, contract with a food recovery organization or service to collect or accept that food, and never intentionally spoil food capable of being recovered.

Commercial edible food generators must also keep five years of records on their food recovery contracts and quantities and file an annual report to the city. 055 separately requires any compost pile to be kept at least six feet from a neighboring inhabited structure's window, door or entrance.

Violations & Fines

Beginning July 1, 2022, Section 6.08.220(H) authorizes civil penalties against any generator, responsible person, self-hauler, hauler, or commercial edible food generator found out of compliance, following the same tiered base penalty in Section 6.08.220(C) of $50 to $100 for a first violation, $100 to $200 for a second, and $250 to $500 for a third or subsequent violation. Before that date, and for newly regulated entities, the city must first provide educational materials describing the obligations under Section 6.08.220(G) before penalties apply.

Frequently Asked Questions

Do Carlsbad residents have to separate food scraps from the trash?
Yes. Section 6.08.020(A)(2) requires every generator to place source-separated organic materials, which Section 6.08.010 defines to include food waste and yard trimmings, into the organics stream of the applicable container rather than the solid waste container.
What must Carlsbad restaurants do with leftover edible food?
Under Section 6.08.027, tier one commercial edible food generators since January 1, 2022, and tier two generators since January 1, 2024, must arrange to recover the maximum amount of edible food that would otherwise be disposed and contract with a food recovery organization or service to collect or accept it.
Can I skip the city's organics cart if I compost at home?
Yes. Section 6.08.020(D)(9) allows composting or otherwise legally managing organic materials at the site where they are generated, including backyard composting or on-site anaerobic digestion, without subscribing to the mandatory organics collection service.
