40's Article II set-out rules, single-family generators cannot commingle organics, recyclables, and MSW: each must go into its own city-approved cart for weekly curbside pickup. Multifamily property owners have the same duty and must give tenants enough labeled containers and instructions to keep the streams separate. If a cart is contaminated with the wrong material, the franchise collector is allowed to leave it uncollected and must notify the generator of the specific reason. The chapter, enacted by Ordinance 11-2021 and made effective January 1, 2022, implements the state's SB 1383 short-lived climate pollutant regulations through the Alameda County Waste Management Authority's countywide Organics Reduction and Recycling Ordinance, which Fremont formally adopted by reference.

Residents who previously proved they generate essentially no organics through composting, at a threshold of one gallon or less per week, or no recyclables at all because they sell, donate, or reuse everything, could apply for a 'zero generator' fee exemption from the director. The city has closed that exemption to new applicants; only households that already held one before the rewrite may keep it by supplying periodic proof to the director, and any dispute over a denial or revocation goes to the administrative hearing officer.

Separately, using the wrong bin specifically to dodge the recyclables or organics fee component is called out as its own violation, distinct from ordinary contamination. Enforcement runs through the community services director, code enforcement staff, and the fire chief or chief building official as designees, who may inspect premises and issue citations under the chapter's general enforcement article.
