Hayward, CA Trash & Recycling: Mandatory Organics Recycling (2026)

Hayward Municipal Code Sec. 10 requires that "all Persons residing, domiciled, or maintaining business or other Premises in the City of Hayward shall subscribe to Collection service on at least a weekly basis for Single-Family Dwelling Units," with more frequent service for multi-family or commercial premises. The franchise system Hayward built to comply with the statewide organics mandate treats "Organic Materials" as its own waste stream: Sec. 01(w) defines Organic Materials as discarded materials that decompose or putrefy, which "Generators separate from Solid Waste and Recyclable Materials for Collection in specially designated Containers for Organic materials Collection," expressly including Yard Trimmings and Food Scraps such as grass, leaves, prunings, food waste, and food-contaminated paper.

No material qualifies as Organic Materials at all unless it is "Source Separated" from solid waste and recyclables, per the same section. Sec. 14 further requires every person in possession of a residential or commercial premises to keep suitable, sufficient, sanitary containers for all of the streams the Franchisee collects. If a new occupant fails to start service, Sec. 18 requires the owner or tenant to begin Collection service within 15 days of occupancy, and if the City finds service was never initiated, it can order the Franchisee to start and continue it after a 15-day written notice period. Sec. 19 allows the City Manager's designee to grant exceptions to the mandatory subscription requirement at their discretion, under Public Works Department policy.
