The City of Durham provides roll-out cart garbage service, with collection schedules set by the solid-waste director. Only City-authorized crews may haul away refuse or recyclables set out for collection; no one else may take your set-out material.
Durham City Code Sec. 58-32 has the director provide roll-out garbage collection and bulk-container service, and Sec. 58-125 makes collection schedules the director's to set and to alter for holidays or emergencies. Sec. 58-3 reserves collection to the City: no person other than one under the director's authority may haul away refuse or recyclables set out for collection. The director may set rules on container size and type, collection location and frequency, and refuse separation (Sec. 58-2). Businesses generating more than about four carts' worth of refuse weekly must use a stationary bulk container rather than roll-out carts.
Violating Chapter 58 or the director's rules subjects the violator to a remedial fee set by City Council resolution; each day is a separate offense. Chapter 58 is enforced civilly, not criminally (Sec. 58-8).
