FMC § 5.14.030 requires the owner, property manager, tenant or person in control of every residential and commercial premises in Fullerton to either subscribe to solid waste handling service with the city's franchisee or register as a self-hauler with the City Manager; only a premises where every unit is vacant and generating no waste is excused, and the owner bears the burden of proving that vacancy (§ 5.14.030(B)). Building on that duty, § 5.14.050(A) and (B) set the baseline pickup rate at not less than once per week for both residential and commercial premises, whether waste goes out through the franchisee or through an approved self-haul arrangement.

The City Manager is not locked into that weekly minimum. Under § 5.14.050(C), if the standard schedule is not enough to prevent a public nuisance at a specific property, whether from excess volume, overflow or unsanitary buildup, the City Manager can give the owner written notice directing a more frequent removal schedule or a switch to additional or larger containers. Failing to keep waste service in effect at all is separately declared unlawful and a public nuisance under § 5.14.060(A): a property with no active franchisee subscription and no valid self-hauler registration is out of compliance regardless of how often waste is actually removed. Construction and demolition projects carry their own container arrangement duty under § 5.14.070, and a building inspector or code enforcement officer can red-tag a job site and halt work until proof of compliant waste handling service is produced.
