Summary
Every multi-family building with more than two units, and every commercial establishment, has had to run a source-separated on-site recycling program since October 1, 2015. Owners, landlords and associations must recycle at least glass, plastic bottles, metal cans, cartons, newspaper, cardboard and paper, and prove annually they are educating tenants and employees.
(a) All new and existing multi-family unit owners, landlords, agents, and associations shall be responsible for implementing an on-site recycling program which must be source separated for each of their multi-family units no later than October 1, 2015, unless otherwise noted and excepted.
(b) The on-site recycling program shall provide for recycling a minimum of the following materials: 1. Glass (brown, green, and clear) food and beverage containers; 2. Plastic beverage bottles and jugs such as soda bottles, milk, water, detergent and shampoo bottles without lids or caps; 3. Metal cans (steel, tin, and aluminum); 4. Aseptics, including milk cartons and juice boxes; 5. Newspapers, including inserts; 6. Corrugated card-board; and 7. Paper, magazines, catalogs, and junk mail.

04(B)(2) required all new and existing multi-family owners, landlords, agents and associations to implement a source-separated on-site recycling program for their units no later than October 1, 2015. 04(B)(3) imposes the same October 1, 2015 mandate on commercial establishments, adding used motor oil and wood to the required recycling stream, though a commercial account with one or fewer waste pickups a month is exempt, and multiple businesses sharing a building or office park can run one shared program. Either group can ask the Director of Public Works in writing for an exception or alternative method, showing the standard program would cause undue hardship not shared by comparable properties; the Director evaluates the request and can approve an alternative if the standard program is not feasible.
Violations & Fines
A multi-family property or commercial establishment that never implemented the required source-separated program, or that fails to submit its annual evidence of an active program and tenant/employee education, is out of compliance with § 50.04(B)(2) and (3). Noncompliance is enforceable the same as other Chapter 50 violations, with penalties under § 10.99.
