Chapter 238 of the Howell Township Code, Recycling and Source Separating, was amended in its entirety on 12-15-2009 by Ord. No. O-09-61. Section 238-1A makes it mandatory for owners, lessees and occupants of residential property, except those physically disabled, to separate recyclables from their solid waste. Section 238-11A extends the duty to owners, tenants and occupants of residential and nonresidential premises, including retail and commercial locations, government and schools. Designated recyclables must be deposited separate and apart from other solid waste and placed separately at the curb on days and times set by Township regulations.
The designated materials come from the Monmouth County District Solid Waste Management Plan and are defined in § 238-2: aluminum cans, glass bottles and jars, plastic bottles coded 1 and 2, steel (tin) cans, newspaper, corrugated cardboard, mixed paper, leaves, grass clippings, brush, natural wood waste, oil-contaminated soil, used motor oil, lead-acid batteries, hazardous dry-cell batteries, metal appliances and whole tires. Under § 238-1E, leaves and branches for recycling pickup cannot be set out earlier than 14 days before the scheduled pickup date.
Owners carry the compliance duty. Section 238-13 makes the owner responsible, and for multifamily units the management or owner must set up and maintain the system and issue collection rules to new tenants on arrival and every six months. Section 238-14 requires nonresidential generators to arrange collection of designated recyclables, report annually to the Municipal Recycling Coordinator, and, for food service establishments, recycle grease and cooking oil. Section 238-12B and C require labeled containers for employees, customers and visitors at businesses and institutions.
Under § 238-25A the chapter is enforced by the Recycling Coordinator, the Monmouth County Health Department, the Monmouth County Solid Waste Enforcement Team, the Howell Township Code Enforcement Officer and any police officer with lawful jurisdiction in the Township.

Section 238-25D sets fines on conviction: a first offense is $25 to $100, a second offense $50 to $200, and a third offense $200 to $1,500. Fourth or subsequent offenses can be assessed the maximum allowable under New Jersey regulations.
