Stockton implements SB 1383 through the green-lid 90-gallon organics cart provided to every single-family household by its franchised hauler. The City updated SMC Title 8 / Chapter 8.04 in June 2022 to align local code with SB 1383 requirements. AB 341 (Mandatory Commercial Recycling, effective July 1, 2012) requires every business generating 4+ cubic yards of solid waste per week and every multi-family property with 5 or more units to subscribe to recycling service. AB 1826 (Mandatory Commercial Organics, fully phased in 2019) extends the recycling requirement to organic waste based on weekly generation. Stockton's franchised haulers offer free on-site waste assessments, bin set-up assistance, and staff training for commercial and multi-family customers. Edible food generators must also arrange recovery with a food-recovery organization under SB 1383 Tier 1 (effective 2022) and Tier 2 (effective 2024).
Failure to subscribe to or properly use required recycling and organics service is a violation of SMC Ch. 8.04 and the state SB 1383 ordinance. CalRecycle authorizes jurisdictions to issue administrative citations of $50–$100 (first), $100–$200 (second), and $250–$500 (subsequent) per violation per day after a compliance period. Repeat or willful non-compliance may be referred to the City Attorney for nuisance abatement.
