Concord runs its curbside recycling program under Sec. 46-32(2) of Chapter 46, Solid Waste, which authorizes the collection of approved recyclable materials prepared in accordance with city standards before placement into the carts, for single-family residences. Under the collection schedule in Sec. 46-37(b), recyclables go out every other week, while regular garbage and yard waste run weekly; the exact pickup day for each area is kept on file with the director of solid waste services. Residents who want a second or third rollout cart must sign an agreement to participate in the curbside recycling program as a condition of getting the extra cart, and Sec.

46-71(c)(1) lets the city remove the additional carts, after a written notice about the importance of recycling, from anyone who takes multiple carts but fails to recycle. Businesses and multifamily complexes are not part of this residential program; instead, Sec. 46-32(6)a gives business, commercial and industrial customers a separate cardboard-only and office-paper recycling cart, collected weekly, while multifamily recycling runs through the same fee-based rollout system used for garbage where bulk dumpsters are not practical. All Chapter 46 violations, including improper recycling cart use, become enforceable civil penalties under Sec. 46-2 once notice and a 48-hour correction period have passed.
