Violations & Fines

Violating Article 9-04 is a class 1 misdemeanor or a civil offense under Article 1-08 (Section 9-04-035). The Neighborhood Services Director or designee can give written notice at least thirty (30) days before the compliance date, with the legal description, an abatement cost estimate and appeal rights (Section 9-04-040). An appeal goes to an independent Hearing Officer before the compliance date (Section 9-04-060). If the owner does not comply, the Town can remove or abate the violation and assess the actual cost (Sections 9-04-070 and 9-04-080).
