Sunrise requires a permit before removing ANY tree, on any property. A tree survey is required unless the lot has five or fewer trees. Under Fla. Stat. §163.045, an arborist-certified dangerous tree on residential property needs no permit, fee, or mitigation.
Under Sec. 16-172 of Sunrise's tree preservation code, a fee-simple owner must obtain a tree removal permit before removing any tree, and removal without a permit is declared a public nuisance. Applications require a certified tree survey unless the property contains five or fewer trees, where a sworn affidavit may be used. In evaluating a permit, the city prioritizes preservation, relocation, replacement, and payment into the city reforestation account. Florida law carves out one exception: under Fla. Stat. §163.045, when an ISA-certified arborist or Florida-licensed landscape architect documents that a tree on residential property poses an unacceptable danger, the city may not require a notice, permit, fee, or mitigation. Utility and post-hurricane emergency removals are also exempt.
