Kyle, TX Water Use Rules: Leak Reporting Duty (2026)

Section 50-91 of the Water Use Management division of Kyle's Code sets both a municipal and a customer-side leak duty. Subsection (f) commits the city to a continuous leak detection survey and requires any city employee who spots a leak to notify the appropriate staff so it can be repaired within a reasonable timeframe. Subsection (i) then binds every person who receives Kyle water service, directly or indirectly, to comply with the Utility Drought Contingency Plan (UDCP) at all times, not just during a declared drought stage.

That subsection lists failing to repair a controllable leak, including a broken sprinkler head, a leaking valve, leaking or broken pipes, or a leaking faucet, as one of several acts that constitute a prohibited waste of water. The same subsection also bars operating a permanently installed irrigation system with a broken head, a head out of adjustment spraying over a street or parking lot, or a head misting from high pressure, and bars allowing irrigation runoff to form a 50-foot trail in the street or to pond more than one-quarter inch deep.

A customer who believes compliance would threaten health, sanitation, fire protection or their primary income source may apply to the city manager under subsection (h) for a written variance, which must then be posted visibly on the property. The leak-repair duty sits alongside, but is legally separate from, the mandatory outdoor watering-day schedule of § 50-92 and the escalating drought-stage restrictions of §§ 50-94 through 50-98, so a leak must be fixed even in a No Drought period under § 50-91(a).
