Gulfport, MS Zoning Overlays & Bonuses: Density Bonus Law (2026)

Appendix D, the SmartCode, is Gulfport's optional form-based alternative to conventional Appendix A zoning, adopted by Ordinance No. 2522 and elected on a Community Planning Area by Community Planning Area basis under Article 3's approval process. 2 governs Density Bonuses within that elected framework. 1, the Planning Official and the Office of the City Attorney jointly issue each Certificate of Density Bonus, and every certificate must uniquely identify the lot that generated the bonus, the program under which it was earned, the number of Equivalent Housing Units awarded, whether it can be transferred to a different site, and its expiration date.

2 caps a certificate's validity at ten years from issue, and proof of the certificate must accompany any application using it; redemption can happen in increments as small as one-half unit. 3 requires the Planning Official to keep permanent redemption records and to publish an annual list of bonuses issued and structures built using them, including tax parcel numbers and street addresses. 1, under which a developer can earn bonus density by producing Certified Affordable Housing units through an Approved Affordable Housing Provider. Because this is a SmartCode-specific tool, it has no effect on property still governed by conventional Appendix A zoning.
