Summary
Lehi's Planned Community (PC) Zone lets developers exceed the base density of three units per acre by up to 40 percent by providing amenities the city values, from recreation facilities to open space and street beautification. The Planning Commission recommends and the City Council decides the final bonus when it approves the Area Plan.
Section 06.110 Density Bonus. Development within a PC Zone is eligible for a density bonus based on additional amenities provided. Density in excess of the base density may be considered for planned communities which satisfy the requirements of one or more of the density bonus amenities listed in this chapter. Each amenity is assigned a potential density bonus figured as a percentage increase in dwelling units. A density bonus shall not exceed 40 percent above the base density. Section 06.120 Density Bonus Amenities. A. An applicant for a PC Zone may include one or more of the following amenities in the design of the development and be considered for a density bonus in accordance with this section. Each amenity is followed by a percentage increase in total density for providing the amenity. The maximum density bonus allowed is equal to a 40 percent increase in dwelling units above the base density.
Full Breakdown
080). 130, and the cap is hard: no PC Zone may exceed 40 percent above base density no matter how many amenities are provided. 120 lists a menu of amenities, each worth a set maximum percentage increase that the Planning Commission may recommend and the City Council may reduce below the listed maximum. Active recreational facilities beyond required multi-family amenities (pools, sports courts, trails) are worth up to 10 percent, as are qualifying common buildings or civic-site donations. Street beautification with meandering landscaped sidewalks is worth up to 5 percent, pedestrian and bicycle enhancements up to 10 percent, entry monuments 2 percent per sign area, and extra open space beyond the required 10 percent minimum is worth 2, 5, or 10 percent depending on how much additional acreage is committed.
Water features add 2 percent per feature, theme lighting and landscaping each add up to 2 percent, unique design features up to 5 percent, and improved street connectivity up to 10 percent. 130 works the math with its own example: a 200-unit base project earning a 20 percent bonus becomes eligible for 240 units, and even a project that qualifies for every listed amenity is capped at 280 units, the 40 percent ceiling. Final total density is fixed only when the City Council adopts the Area Plan under Chapter 15.
Violations & Fines
The 40 percent ceiling in Section 06.110 is absolute: the Planning Commission and City Council cannot approve a PC density total above it regardless of how many amenities a developer offers. Amenity-specific bonuses can also be forfeited for noncompliance; Section 06.120.2 requires common buildings or facilities to be constructed before 25 percent of the development's building permits are issued, and the City Council may award less than the listed maximum for any amenity it finds insufficiently justified.
