D. Bonus provisions. Under Code § 118-1050D(1), where workforce housing units are built on the same site as an integral part of a new market-rate development in the Central Business District, South Norwalk Business District, Washington Street Design District or Reed Putnam Design District, the Zoning Commission allows an increase in the permitted number of dwellings of not more than 20%. 5-to-1 for households up to 80%. Section 118-1050D(2) lets a project stack an additional 10% once the first tier is met, for a maximum 30% density bonus, using a 1-to-1 market-rate-to-workforce ratio for units serving households up to 100% of state median income.
Section 118-1050D(3) adds further relief for bonus developments: the Commission may modify yard, building area and floor area ratio requirements by up to 10% and permit one additional story, if the applicant demonstrates the changes will not adversely affect adjacent properties or public health, safety and welfare. The underlying base obligation, in § 118-1050C(2), requires developments of 20 or more units to set aside a minimum of 10% as workforce housing units, so the density bonus in Subsection D is an added incentive layered on top of, not a substitute for, that base requirement.
Violations & Fines
Workforce units created to earn the density bonus carry deed restrictions under § 118-1050E(3): units for sale may not resell above the calculated maximum price, and units for rent may not exceed the calculated maximum monthly rent, both maintained in perpetuity. A development that fails to maintain these restrictions, or that occupies a bonus unit outside the required income and priority categories, is out of compliance with the Zoning Regulations and subject to the Code's default penalty, § 7-8: a fine of up to $500 per day the violation continues.
