S. " The same subsection layers on specific street-level standards: on arterial roads and on Burnell Boulevard, Commerce Street and Isaac Street (plus the first 25 feet of any intersecting street), a portion of the street-level floor must contain a street-activating use, and those frontages must provide pedestrian access to an abutting street with a welcoming, active presence rather than a blank wall. Developments fronting those same streets, plus Maple Street, must build sidewalks at least seven feet wide, including a two-foot snow shelf and a maintained five-foot clearance from obstructions; permanent obstructions like utility equipment need Commission and Redevelopment Agency approval.
Cupolas, towers and spires that do not exceed 1% of building area and are not used for habitable space are exempt from height limits, subject to Commission approval. C(7). Applicants also need to consult the district's separate Schedule Limiting Height and Bulk of Buildings, which is referenced but not reproduced in the text of § 118-504.
Violations & Fines
Compliance is enforced through the Planning and Zoning Department's site plan review process under § 118-1451; a project that does not conform to the Central Business Design Guidelines or the street-activation, sidewalk and screening standards in § 118-504.C cannot receive site plan or zoning approval. Buildings existing before the section's adoption that do not conform are treated as legally nonconforming under § 118-800 rather than cited outright, unless changes trigger Flood Hazard Zone or coastal area management requirements.
