Full Breakdown
Under UDC § 4.02.02(D), the City of Indio, Riverside County, California imposes no impact fees on an accessory dwelling unit or junior ADU under 750 square feet, matching the fee waiver required by state ADU law. Utility connection fees and capacity charges aren't affected by this exemption. Once an ADU reaches 750 square feet or more, the city charges impact fees proportionate to the square footage of the primary dwelling unit rather than a flat citywide schedule. State ADU law (Gov. Code §§ 66310-66342) sets the floor for these protections and overrides any conflicting local restriction, so Indio's ordinance tracks, but does not exceed, what state law already requires.
Violations & Fines
Charging any impact fee on an ADU or JADU under 750 square feet, or a flat non-prorated fee on a larger unit, violates UDC § 4.02.02(D) and state ADU law.
