Toledo does not have a citywide statutory owner-occupancy mandate for ADUs in the Toledo Municipal Code. However, Toledo Plan Commission special use permit and Board of Zoning Appeals variance approvals for ADUs commonly include owner-occupancy as a condition. Toledo's rental registration program under TMC Chapter 1726 requires registration of non-owner-occupied rental dwellings. Ohio has no state preemption on local owner-occupancy conditions.
The Toledo Municipal Code does not contain a general statutory owner-occupancy requirement that conditions ADU permits. However, when ADUs are approved through Toledo Plan Commission special use permit or Board of Zoning Appeals variance, the approving body frequently imposes an owner-occupancy condition in the order - typically requiring the owner to reside in either the primary dwelling or the ADU. Approved two-family dwellings in RD6 and higher-density zoning districts have no owner-occupancy requirement. Toledo's rental certification program under TMC Chapter 1726 (Housing Code) requires registration and periodic inspection of non-owner-occupied rental dwellings through the Department of Inspection. Lead-safe certification may be required under TMC Chapter 1760 and Ohio Department of Health rules for pre-1978 rental units. Ohio Revised Code does not preempt municipal owner-occupancy conditions. Condominium and HOA covenants under ORC Chapter 5311 (Ohio Condominium Act) and ORC Chapter 5312 (Ohio Planned Community Law) may impose additional private restrictions.
Violation of a special use permit or BZA variance condition (including owner-occupancy) can result in revocation of the approval and certificate of occupancy by the Director of Inspection. Rental registration violations under TMC Chapter 1726 carry fines up to $500 per occurrence plus inability to enforce rental contracts under Ohio Landlord-Tenant Act (ORC Chapter 5321). HOA and condo violations follow declaration-based procedures under ORC 5311 and 5312.
